An 80-year-old man, who s locked in a property dispute with his wife, assaulted her lawyer with a walking stick during a hearing of the case at the family court in Navrangpura on Wednesday.

The attack on advocate Mahindrasinh Rajput was severe that he bled heavily in the courtroom even as other lawyers tried to prevent the elderly man, Ganesh Shankar Pathak, from harming him further.

The incident, which stunned the judge and courtroom audience, happened at about 1.15 pm when Rajput made an argument on behalf of Pathak’s 75-year-old wife, Prabha.

Property row

Last year, Prabha filed a case against her husband, challenging his decision to sell their house in Meghaninagar. The court had then put a stay on the proposed sale. On Wednesday, Rajput opposed the sale and urged the court to extend the stay. This angered Pathak so much that he raised his walking stick and hit the 45-year-old lawyer.

“He (Pathak) hit me twice, first on my head and then on my left hand,” Rajput alleged. The elderly man, he claimed, even abused him before beating him. “When I appealed to the court to extend the stay on the proposed sale of the house, he said: ‘Tara baap nu ghar che (does this property belong to your father)’,” the lawyer said.

Uproar in court

The assault led to uproar in the courtroom. Even the judge, Rajput said, stood up from his chair. “Pathak would have continued to hit me had lawyers not stopped him,” he said. The 45-year-old advocate claims that Pathak has a history of violent behaviour. When Prabha opposed his decision to sell their house for the first time, he hit her, Rajput alleged. “Fed up with his behaviour, she shifted to their son’s house,” Rajput said.

The lawyer, who has filed a complaint against Pathak in the Navrangpura police station, was taken to VS Hospital after the assault. He had to take four to five stitches.
