Regarding non compliance of MHA circular by “Government of Karnataka”

Taking acknowledgement of the rampant misuse of the 498A IPC, “Union Ministry of Home Affairs” had issued an Advisory to all the state governments and UT’s, dated 20-October-2009 vide no 3/5/2008-Judl Cell.

Acting on the said Advisory of the “Union Ministry of Home Affairs” only the “Maharashtra Government” has issued a state level circular.

Main highlights of the circular issued by the “Maharashtra Government” are below.

  • Police should not arrest the accused without a warrant.
  • Police should conduct a preliminary inquiry before filing a First Information Report (FIR)
  • Police told to first verify the complaint before registering it


National Family Harmony Society® is requesting for a similar circular for the “Karnataka Police” from the “Government of Karnataka” so that heavy misuse of the 498A IPC can be curbed and innocent husbands and his family members who are being implicated in the false cases can get some respite and relief. Till date there is no circular issued from the “Government of Karnataka”. The state police is not obliged to follow a central Advisory, thus defeating the very purpose of the MHA advisory.

In this regard we National Family Harmony Society® yourself to kindly direct the “Government of Karnataka” to issue a circular for the “Karnataka Police”.
